Can I be fined for picking mushrooms?

This weekend, September 17-18, the mushroom season will begin in the Moscow region, said TASS scientific director of the Russian Hydrometeorological Center Roman Vilfand.

Mushrooms should not be picked along busy roads and airports, it is better to leave at least a kilometer from them. Rospotrebnadzor recommends collecting only well-known types of mushrooms away from roads, highways, outside populated areas, in ecologically clean areas.

Rospotrebnadzor experts advise picking mushrooms in wicker baskets — so they stay fresh longer. Can they be punished for picking mushrooms?

Citizens can pick mushrooms in the forests for their own needs (part 1, article 11, part 1, article 35 of the Forest Code of the Russian Federation). The exception is national parks. They prohibit the harvesting of food forest resources, except for the zone intended to ensure the life of the indigenous peoples of the Russian Federation, as well as the territory of settlements included in the national parks (Article 27, Part 2, Article 35 of the RF LC).

In Moscow, for picking mushrooms in city parks and specially protected areas, the violator faces a fine (part 2 of article 30 of the Law of Moscow “On Specially Protected Natural Territories in the City of Moscow”) in the amount of:

  • from 15 to 20 thousand rubles — for officials;
  • up to one million rubles — for legal entities.

The law also prohibits the collection of certain mushrooms and wild plants (Part 3, Article 11 of the Labor Code of the Russian Federation). These include:

• listed in the Red Book of the Russian Federation, the Red Books of the constituent entities of the Russian Federation (for example, summer truffle, Russian black truffle);

• recognized as drugs. Under article 228 of the Criminal Code of the Russian Federation “Illegal acquisition, storage, transportation, manufacture, processing of narcotic drugs” the violator faces a fine of 40 thousand rubles and even imprisonment for up to 10 years.
